The Aden Public Funds Court held its public session today, headed by the President of the Court, Judge Dr. Sami Ahmed Baabad, in the presence of Public Prosecution Member Najeeb Ahmed Saif, and in the presence of the Secretary of the Session, his counterpart Abdul Hakim Abdul Qawi, in Criminal Case No. 16 of 1443 AH.

The court’s ruling stated the following:

First: Accepting the defense presented by the lawyer acting for the defendants in form and rejecting it as a matter of its illegality and lack of validity, according to what we explained in the merits.

Second: Convicting Muhammad Yahya Abdullah Al-Shami and Ali Naji Salim of the incident of assault on state lands and real estate attributed to them in the indictment, and punishing them for that with a full year’s imprisonment.

Third: Obliging the above civilians to return the land that is the subject of the above-mentioned indictment and hand it over to the state represented by the General Authority for Lands, Survey and Urban Planning, within whose jurisdiction the land that is the subject of the indictment is located.

Fourth: All actions undertaken by the above convicts on the land subject to the indictment shall be invalidated and considered as if they had not occurred.

Fifth: Obligating the General Authority for Land, Survey and Urban Planning to compensate the members of the Al-Farouq Agricultural Cooperative Society for the land subject to the indictment, according to what is detailed in the decision of the Committee for Handling Land Ownership Claims Cases No. 2 of 2009 AD issued on 12 Shaban 1430 AH corresponding to 3/8. / 2009 AD and consider it an integral part of this ruling in this regard and implement it as a matter of urgency.

Sixth: Obligating those convicted in Clause Two of this operative part to pay litigation losses in the amount of three hundred thousand riyals, to be paid to the legal representative of the General Authority for Lands, Survey and Urban Planning, M/Aden.

Seventh: Return the case file to the Public Prosecution to act in accordance with the law
